SCMA Files Petition for Leave to Intervene

SC Manufacturers Intervene in SC Supreme Court to Uphold Constitutionality of Sales Tax Exemptions that Create Manufacturing Jobs.
 
(COLUMBIA, S.C.) - The South Carolina Manufacturers Alliance (SCMA) filed a petition for leave to intervene in the South Carolina Supreme Court in the case of Bodman V. State of South Carolina and the South Carolina Department of Revenue.  The SCMA is seeking the courts’ permission to intervene in support of upholding the constitutionality of sales tax provisions in the South Carolina code.  
 
On behalf of its hundreds of manufacturing members who create thousands of South Carolina jobs, the manufacturers argue in the brief that, “certain of these statutory provisions are critical for job creation and economic development in South Carolina and are of vital interest to the members of the Alliance.  Simply put, many of the members of the SCMA will not be able to compete in the worldwide economy without sales tax exemptions afforded to manufacturers.”

SCMA President & CEO, Lewis F. Gossett, notes that “South Carolina’s highest manufacturers property taxes in the nation, make it fundamentally necessary for the sales tax exemptions to be used to create a balanced competitive climate that creates jobs and investment in South Carolina. Without these sales tax exemptions, South Carolina cannot compete for the new jobs and investments that grow and build opportunities for South Carolina families.”
 
The attorney for the plaintiff is South Carolina trial lawyer, Dick Harpootlian. Attorney petitioning the court for SCMA is Nexsen Pruet Attorney, Burnie Maybank, III.  The case has been granted original jurisdiction by the SC Supreme Court.
